Mystery Enterprises, LLC (“Mystery Enterprises,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of our websites, digital games, applications, and related services (collectively, the “Services”) to do the same. This DMCA Policy is governed by the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512, and applicable federal and California state laws.

This Policy applies to all content hosted, distributed, or made available through Mystery Enterprises’ web-based platform and is incorporated by reference into our Terms of Service, Privacy Policy, and Refund Policy. In the event of any conflict, the Terms of Service control to the maximum extent permitted by law.

This DMCA Policy applies to all content made available through Mystery Enterprises’ web-based platform, including, but not limited to:

• Automated Murder Mystery Games™, as defined in the Terms of Service
• Player-uploaded content (including photos uploaded during gameplay)
• Marketing materials, text, images, audio, video, and software

Mystery Enterprises operates as a digital service provider and, where applicable, relies on the DMCA’s safe harbor provisions. This Policy governs copyright-related notices, counter-notifications, and takedown procedures for both proprietary content and user-submitted materials.

2. Copyright Ownership and Platform Status

All original content made available through the Services—including software, audiovisual elements, story content, game logic, and branding—is owned by or licensed to Mystery Enterprises and is protected by U.S. and international copyright laws.

User-uploaded content remains the responsibility of the user who uploads it. Mystery Enterprises does not pre-screen user uploads and does not claim ownership of such content.

Certain game mechanics and formats may also be protected under trademark and trade secret law.

3. Automated Content Integrity and Rights Protection

Mystery Enterprises employs proprietary, rules-based automation and content identification systems to help protect its copyrighted works, trademarks, and digital assets made available through its web-based platform, including content delivered under the Automated Murder Mystery Game™ format.

These systems may be used to detect, identify, flag, and document unauthorized reproductions, counterfeit implementations, or materially altered versions of Mystery Enterprises’ proprietary game content.

Automated monitoring tools are deployed solely to safeguard intellectual property rights, preserve the integrity of authentic gameplay experiences, and protect users from counterfeit or unauthorized game materials. Any enforcement actions resulting from such monitoring are conducted in accordance with applicable law, including the Digital Millennium Copyright Act (17 U.S.C. § 512), and do not replace the formal notice-and-takedown procedures described in this Policy.

4. Filing a DMCA Takedown Notice

If you believe that content available through the Services infringes a copyright you own or control, you may submit a written DMCA takedown notice that includes all of the following:

• A physical or electronic signature of the copyright owner or an authorized agent
• Identification of the copyrighted work claimed to have been infringed
• Identification of the allegedly infringing material and its location on the Services
• Your name, mailing address, telephone number, and email address
• A statement of good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act

5. Counter-Notification Procedure

If you believe material you uploaded was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification including:

• Your physical or electronic signature
• Identification of the removed material and its prior location
• A statement under penalty of perjury of good-faith belief of error
• Your name, address, telephone number, and email address
• Consent to jurisdiction of the appropriate federal district court in California

Valid counter-notifications should be submitted to the DMCA Agent listed above.

6. Repeat Infringers

Mystery Enterprises maintains a policy of terminating access, in appropriate circumstances and at its sole discretion, for users determined to be repeat copyright infringers.

7. False or Abusive Notices

Submitting knowingly false, misleading, or abusive DMCA notices or counter-notifications may result in liability under federal law. Mystery Enterprises reserves the right to pursue legal remedies for bad-faith submissions.

8. Relationship to Other Policies

This DMCA Policy should be read together with:

• Terms of Service – governing acceptable use, dispute resolution, arbitration, and enforcement
• Privacy Policy – governing user data, uploaded content, and disclosures
• Refund Policy – governing digital purchases and access rights

Nothing in this DMCA Policy limits Mystery Enterprises’ right to remove content or suspend access for violations of our other policies or applicable law.

9. No Waiver of Rights

Failure to enforce any provision of this Policy does not constitute a waiver. All rights not expressly granted are reserved.
