These Terms of Service (“Terms”) govern your access to and use of the websites, digital games, applications, and related services operated by Mystery Enterprises, LLC, a California limited liability company (“Mystery Enterprises,” “we,” “us,” or “our”) (collectively, the “Services”).
By accessing or using the Services, including by clicking “I Agree,” creating an account, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Refund Policy, and DMCA Policy, each of which is incorporated by reference. If you do not agree, you must not use the Services.
1. Description of the Services
Mystery Enterprises provides proprietary, automated, host-free interactive digital game services, including Automated Murder Mystery Games™, a proprietary interactive game system developed and offered by Mystery Enterprises and delivered digitally through our web-based platform and supported devices.
The Services provide automated interactive mystery games that do not require a live host, game master, or facilitator. Gameplay is guided exclusively through structured digital interfaces accessed by players on personal devices and a shared display.
Mystery Enterprises, LLC is a California-based company serving users in the United States and internationally and specializing in automated interactive games. The Services are provided solely for personal, non-commercial entertainment purposes unless expressly authorized in writing by Mystery Enterprises.
1.2 Definitions
“Automated Murder Mystery Game™” means a proprietary, fully digital, host-free interactive mystery game format developed by Mystery Enterprises in which software automation performs all traditional hosting, facilitation, pacing, orchestration, and vote-tallying functions.
The Automated Murder Mystery Game™ format offered by Mystery Enterprises is characterized by a dual-screen experience in which:
(i) a shared main display presents narrative, audiovisual, and gameplay content, and
(ii) individual player devices deliver private character information, clues, prompts, and voting mechanisms in real time.
Because all operational and administrative functions are performed by software, no participant—including the purchaser or organizer—serves as a host, moderator, or facilitator, and all participants engage solely as active players.
Automated Murder Mystery Games™ are distinct from downloadable kits, boxed games, live-hosted events, actor-led experiences, or app-assisted formats that require manual hosting or facilitation.
Automated Murder Mystery Game™ and Automated Murder Mystery Games™ refer exclusively to the proprietary game format developed and offered by Mystery Enterprises and do not describe a general category of games. All references in these Terms to Automated Murder Mystery Game™ or Automated Murder Mystery Games™ refer solely to this proprietary format.
Trademark Notice: Automated Murder Mystery Game™ and Mystery Enterprises™ are trademarks of Mystery Enterprises, LLC. The Mystery Enterprises / Automated Murder Mystery Games logo is a trademark and design mark of Mystery Enterprises, LLC.
2. Fictional Content and Entertainment Purpose
All games, stories, characters, scenarios, events, crimes, and outcomes made available through the Services are entirely fictional and created solely for entertainment purposes.
The Services do not depict, promote, endorse, or provide instruction regarding real-world violence, criminal conduct, or harmful activity of any kind. Any resemblance to actual persons, living or deceased, or to real events is purely coincidental.
3. Eligibility and User Representations
You must be at least thirteen (13) years of age to use the Services. If you are under eighteen (18) or the age of majority in your jurisdiction, you may use the Services only with the consent and supervision of a parent or legal guardian.
By using the Services, you represent and warrant that:
- You meet the eligibility requirements
- You will comply with these Terms and all applicable federal, state, and local laws
- All information you provide is accurate, current, and complete
Mystery Enterprises does not knowingly permit use of the Services by children under 13 in violation of applicable law.
4. Accounts and Security
Certain features of the Services may require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.
You agree to notify Mystery Enterprises promptly of any unauthorized access. We are not responsible for losses resulting from unauthorized account access unless caused by our gross negligence.
5. Digital License; Access Period
Upon purchase, Mystery Enterprises grants you a limited, non-exclusive, non-transferable, revocable license to access the purchased game through the Services for a period of exactly two (2) months from the date of purchase (the “Access Period”).
Key terms of this time-limited digital access include:
- Access expires automatically at the end of the Access Period
- No refunds are provided for unused time
- Game content, storyline, and solutions remain the same across playthroughs
- Replays are permitted but may reduce gameplay integrity once the solution is known
- New players may participate during the Access Period
No ownership rights are transferred. All rights not expressly granted are reserved by Mystery Enterprises.
6. Purchases and Payments
Digital purchases are processed through third-party payment processors, including PayPal. Mystery Enterprises does not store full payment card information.
All purchases are subject to the Refund Policy, which governs eligibility, limitations, and legal exceptions. Digital purchases are final except where required by applicable law.
7. User-Uploaded Content and Photo Consent
During gameplay, users may upload photographs for in-game identification purposes only, including:
- Display on the Cast of Characters screen
- Display during in-game voting
Before uploading any photograph, users must affirmatively confirm that they have obtained permission from every individual depicted.
By uploading photos, you represent and warrant that you have obtained all required consents and that the upload does not violate any law or third-party rights. Mystery Enterprises relies on this confirmation and disclaims responsibility for unauthorized uploads. Photographs are displayed only within the game environment and are not made public.
8. No Instructional or Real-World Application
The Services are not intended to provide guidance, instruction, or encouragement for real-world acts of violence or unlawful conduct.
Users agree not to interpret, adapt, replicate, or apply any fictional content, game mechanics, narratives, or scenarios from the Services to real-world situations. Any such use is outside the intended scope of the Services and is undertaken solely at the user’s own risk.
9. Intellectual Property
All content within the Services, including software, text, artwork, audio, game mechanics, trademarks, and logos, is owned by or licensed to Mystery Enterprises and protected by applicable intellectual property laws.
Automated Murder Mystery Games™ and related marks are trademarks of Mystery Enterprises, LLC. Unauthorized use of Mystery Enterprises’ branding or content is prohibited.
10. Proprietary Automation and Game Logic
The Services utilize Mystery Enterprises’ proprietary automation framework. Users acknowledge that the underlying logic structures, automated narrative sequencing, rules-based orchestration, and system workflows used to facilitate Automated Murder Mystery Games™ constitute confidential and proprietary technology and protected trade secrets of Mystery Enterprises. For clarity, this automation is rules-based and deterministic in nature and does not involve training external artificial intelligence or machine learning models on user data.
Any attempt to access, analyze, reverse-engineer, decompile, or replicate the automated logic, sequencing, or system behavior of the Services without express authorization is strictly prohibited and constitutes a violation of these Terms.
11. Acceptable Use and Prohibited Conduct
You agree not to:
- Upload content without proper consent
- Reverse engineer or exploit the Services
- Use bots, cheats, or automated systems
- Interfere with servers or gameplay
- Harass or disrupt other users
- Violate applicable laws
We reserve the right to suspend or terminate access for violations.
12. DMCA Copyright Policy
Mystery Enterprises complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). Copyright complaints must be submitted in accordance with our DMCA Policy.

13. Third-Party Merchandise
The Services may link to third-party websites that sell branded merchandise. These transactions occur on third-party platforms and are governed by their terms and policies. Mystery Enterprises is not the seller of record and disclaims responsibility for fulfillment, shipping, or returns.
14. Platform Dependency and Third-Party Services
The Services rely on third-party infrastructure, including hosting, payment processors, analytics providers, internet service providers, and device platforms. Mystery Enterprises is not responsible for outages, errors, or limitations caused by third-party systems.
15. Platform Evolution and Compatibility
We may modify the Services to maintain compatibility or compliance. Continued access may require updated devices, browsers, or environments. Compatibility is not guaranteed indefinitely.
16. Force Majeure
Mystery Enterprises is not liable for failure or delay caused by events beyond reasonable control, including natural disasters, pandemics, government actions, labor disputes, or infrastructure failures.
17. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
ALL WARRANTIES ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
18. Limitation of Liability and Assumption of Risk
Users voluntarily assume all risks associated with participation in the Services.
To the maximum extent permitted by law, Mystery Enterprises shall not be liable for indirect, incidental, consequential, or punitive damages. Total liability shall not exceed the amount paid by the user in the six (6) months preceding the claim.
19. Indemnification
You agree to indemnify and hold harmless Mystery Enterprises from claims arising from your use of the Services, uploaded content, or violation of these Terms.
20. Mandatory Arbitration; Class Action Waiver
Any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in California. Class actions are waived.
21. Exclusive Forum Selection
Non-arbitrable disputes shall be brought exclusively in state or federal courts located in Contra Costa County, California.
22. Governing Law
These Terms are governed by the laws of the State of California and applicable U.S. federal law.
23. Changes to These Terms
We may update these Terms. Continued use constitutes acceptance.
